href=\"https:\/\/www.smh.com.au\/politics\/federal\/electric-vehicle-tax-unites-states-in-high-court-stoush-against-the-commonwealth-20221115-p5byj0.html\" target=\"_blank\" rel=\"noreferrer noopener\">The Sydney Morning Herald<\/a><\/em> \u2013 and it\u2019s all to do with which governments collect taxes from electric car owners.<\/p>\n<p><\/span><\/div>\n<div class=\"blocks_drive-block__wrapper__nDI7m\"><span class=\"paragraph_drive-paragraph-block__03kVn\"><\/p>\n<p>The case argues against Victoria and its road-user charge, which was brought about by two electric car owners in late 2021 and now has the backing of the Federal Government.<\/p>\n<p><\/span><\/div>\n<div class=\"blocks_drive-block__wrapper__nDI7m\"><span class=\"paragraph_drive-paragraph-block__03kVn\"><\/p>\n<p>The rest of Australia\u2019s states and territories \u2013 apparently keen to intercept the electric-car revenue stream before it gets to the Federal Government \u2013 are standing behind Victoria.<\/p>\n<p><\/span><\/div>\n<hr class=\"blocks_drive-block__ad__hr__Ifhs_\" style=\"height:0\"\/>\n<hr class=\"blocks_drive-block__ad__hr__Ifhs_\" style=\"height:0\"\/>\n<div class=\"blocks_drive-block__wrapper__nDI7m\"><span class=\"paragraph_drive-paragraph-block__03kVn\"><\/p>\n<p>Victoria introduced the Zero- and Low-Emissions Vehicles (ZLEV) distance-based charge on 1 July 2021 and imposes a 2.6 cent levy for every kilometre driven by an electric or hydrogen car, and 2.1 cents per kilometre for plug-in hybrids.<\/p>\n<p><\/span><\/div>\n<div class=\"blocks_drive-block__wrapper__nDI7m\"><span class=\"paragraph_drive-paragraph-block__03kVn\"><\/p>\n<p>The Victorian Government said the levy was designed to replace fuel excise \u2013 a 44.2 cents-per-litre tax collected by the Federal Government and then distributed to the states as it sees fit \u2013 because electric vehicles were in effect getting a free ride by bypassing this revenue stream.<\/p>\n<p><\/span><\/div>\n<div class=\"blocks_drive-block__wrapper__nDI7m\"><span class=\"paragraph_drive-paragraph-block__03kVn\"><\/p>\n<p>With the ability to drive with either battery or petrol power, Victorian owners of plug-in hybrids pay both taxes.<\/p>\n<p><\/span><\/div>\n<hr class=\"blocks_drive-block__ad__hr__Ifhs_\" style=\"height:0\"\/>\n<hr class=\"blocks_drive-block__ad__hr__Ifhs_\" style=\"height:0\"\/>\n<div class=\"blocks_drive-block__wrapper__nDI7m\"><span class=\"paragraph_drive-paragraph-block__03kVn\"><\/p>\n<p>Supporting the legal action, the Commonwealth filed a submission which argued the ZLEV charge was a tax on goods \u2013 something only the Federal Government can impose.<\/p>\n<p><\/span><\/div>\n<div class=\"blocks_drive-block__wrapper__nDI7m\">\n<div class=\"gallery_drive-post__gallery__wrapper__peh4_ gallery_drive-post__gallery__inline-carousel__8cm_S\">\n<div class=\"glideSlider_glide__EvBGd\">\n<div class=\"glideSlider_glide__track__FdKW5\" data-glide-el=\"track\">\n<div class=\"paragraph_drive-paragraph-block__03kVn\"><\/p>\n<p>Attorneys-General from all other Australian states and territories have also intervened in the case, filing submissions in support of Victoria\u2019s defence \u2013 arguing the ZLEV charge is a usage consumption tax.<\/p>\n<p><\/span><\/div>\n<hr class=\"blocks_drive-block__ad__hr__Ifhs_\" style=\"height:1.63rem\"\/>\n<hr class=\"blocks_drive-block__ad__hr__Ifhs_\" style=\"height:1.63rem\"\/>\n<div class=\"blocks_drive-block__wrapper__nDI7m\"><span class=\"paragraph_drive-paragraph-block__03kVn\"><\/p>\n<p>The Australian Trucking Association has backed the plaintiffs, with a view to reduce the financial burden of couriers and trucking operators.<\/p>\n<p><\/span><\/div>\n<div class=\"blocks_drive-block__wrapper__nDI7m\"><span class=\"paragraph_drive-paragraph-block__03kVn\"><\/p>\n<p>The case will be heard in the High Court in February 2023.<\/p>\n<p><\/span><\/div>\n<div
